Workers’ Compensation laws provide fixed monetary awards to employees who are injured or disabled on the job, without requiring them to having to endure expensive and time-consuming civil litigation. The injury or illness must arise out of or occur in the course of the employee’s employment in order for the workers’ compensation system to provide benefits. Benefits are also available to dependents of workers who have been killed due to work-related injuries or illnesses.
Workers’ Compensation benefits are paid without regard to fault; negligence on the part of neither the employee or the employer is considered in the award of benefits. Awards are generally limited to compensatory damages, those which compensate the employee for his loss or injury and nothing more.
